Personal Trainer Official Rules

ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. Offer Period. The Smoothie King Personal Trainer Offer (“Offer”) begins at 6:00 a.m. Eastern Time (“ET”) on 1/7/2025 and ends at 11:59:59 p.m. ET on 1/31/2025, OR while supplies last (“Offer Period”).

2. Eligibility. The Offer is open to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age or older (19 years of age or older in NE and AL) as of January 7, 2025, excluding employees, directors or officers of the Sponsor, its subsidiary or affiliated companies, representatives, dealers and agents, (the “Offer Entities”), and those who are immediate family members of and/or domiciled with any of the foregoing, and who are certified fitness trainers, yoga instructors, Pilates instructors, or other fitness instructors, and in good standing. The Offer is subject to all applicable federal and local laws and regulations and is void outside of the 50 US/DC and where restricted, taxed or prohibited.

3. How to Participate. During the Offer Period eligible participants may enter via the internet by completing the electronic submission form at Sponsor’s website located at https://skpromo.formstack.com/forms/2025_personal_trainer_discount_program (“Website”), including their name, email address and upload a copy of a valid fitness trainer certificate.

For purposes of this Offer, “receipt” of an internet submission occurs when Sponsor/Administrator’s server records the submission information resulting from the entrant selecting the “Submit” button. Automated submissions (including but not limited to submissions submitted using any robot, script, macro, or other automated service) are not permitted and will be disqualified. Entrants may not enter using multiple email addresses.

Limit of one (1) submission per email or household address during the Offer Period. If more than one (1) submission is received from the same Participant, telephone number and/or e-mail address during the Offer Period, the submissions may, at the Sponsor’s sole discretion, be disqualified. Proof of submission will not be deemed to be proof of receipt of submission by Sponsor. All submissions will be verified by Arrowhead Promotion and Fulfillment Co., Inc., (the “Administrator”), an independent judging organization whose decisions are final and binding in all matters relating to this Offer. Submissions that are not valid may not be responded to. This offer is Good While Supplies Last.

4. Offer:, Smoothie King will verify submissions and the first one-thousand (1,000) verified participants will each receive a 25% discount at Smoothie King throughout 2025. Participants will receive a 25% off coupon in their Healthy Rewards account—once spent, the offer will be replaced by another 25% off coupon. All applicable taxes on the Offer, if any, are the sole responsibility of the participants. Please allow 3-5 business days for notification of eligibility and points award status.

5. Offer Conditions. By participating in this Offer, each entrant consents to the use of their submission, name, email address, and mailing address for the purpose of administration of the Offer. All submissions become the property of the Sponsor. All submissions that are incomplete, illegible, damaged, irregular, inappropriate, have been submitted through illicit means, or do not conform to or satisfy any condition of these Terms and Conditions may be disqualified by the Sponsor. Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed submissions, or for typographical or other production errors. Sponsor is not responsible for any errors or omissions in printing or advertising this Offer. By participating in this Offer, participants release and hold harmless the Sponsor, and the Offer Entities, and each of their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with and/or participation in this Offer or any Offer-related activity; any use, misuse or nonuse of an Offer; and for any claim based on a violation of privacy or publicity rights, defamation, misappropriation, false association, intellectual property infringement or breach of contract. This Offer will be administered in accordance with these Terms and Conditions, subject to amendment by Sponsor as set forth herein. Entrants must comply with these Terms and Conditions, and by participating in the Offer will be deemed to have received and understood these Terms and Conditions. IN NO EVENT WILL THE RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE AND/OR OFFER, DOWNLOADING FROM AND/OR PRINTING MATERIAL ASSOCIATED WITH THE WEBSITE OR OFFER.

6. Disclaimer. Neither Sponsor nor Offer Entities assume responsibility for failure of the internet or the website during the Offer Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or device related to or resulting from playing or downloading any material in the Offer. Sponsor reserves the right, in its sole discretion, to cancel, suspend or otherwise modify this Offer, cancel any method of submission or void any submissions submitted fraudulently should unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of this Offer. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Offer is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

7. Privacy Policy. Sponsor is collecting personal data about the entrants solely for the purpose of administering this Offer. No further informational or marketing communications will be received by entrants unless entrants provide Sponsor with permission to do so.
